We understand that your trust is an important asset of Immowi International BV (hereinafter "Immowi International", "Immowi", "we" or "us"). Your privacy is therefore important to us.

This privacy policy (hereinafter the "Privacy Statement") applies to:

• our websites, including https://www.immowi.com/ and the other websites we operate (hereinafter the "Websites");
• the landing pages and project pages prepared by Immowi International for the benefit of its project partners (hereinafter the "Landing Pages");
• the personal environment we make available to interested visitors through MyImmowi (hereinafter the "Personal Profile"); and
• all commercial and professional relationships between Immowi International, its prospects, project partners or other customers, business partners and suppliers.

This Privacy Statement explains which personal data Immowi International collects and how those data are used, shared, stored and otherwise processed.

Immowi International endeavours at all times to act in accordance with the applicable privacy legislation, including:

• the Belgian Act of 30 July 2018 on the protection of natural persons with regard to the processing of personal data;
• Regulation (EU) 2016/679 of 27 April 2016 (the "GDPR");
• Directive 2002/58/EC (the "ePrivacy Directive") and the Belgian Code of Economic Law, insofar as they govern electronic communications and direct marketing; and
• other privacy laws and regulations applicable to Immowi International.

Please read this Privacy Statement together with our legal disclaimer and cookie policy.

The main activity of Immowi International, under the name Immowi.com, consists of lead generation and marketing services for real estate project partners.

For this purpose, Immowi International prepares Landing Pages concerning the real estate projects of its project partners. These pages may contain information such as the location of the project, number and type of units, price ranges, floor plans, photographs and other project information.

Parts of a Landing Page, including photographs, videos, text and articles, may be used in advertisements distributed through advertising and marketing platforms such as Meta and Google.

A visitor who clicks on such an advertisement may arrive on a Landing Page. If the visitor is interested in a project, they can submit a contact form requesting additional information.

Depending on the project and the way the campaign is organised, the identity of the project partner may appear on the Landing Page.

What happens after you submit a form

When you submit a request concerning a project, Immowi International may forward your request and the information you provided to the relevant project partner so that the project partner can contact you about the project.

Immowi International may also contact you itself by e-mail, telephone, SMS, WhatsApp or another appropriate communication channel in order to:

• confirm your request and share information about the project;
• verify the details provided;
• determine whether your request is genuine;
• check whether the project partner has followed up your request;
• answer questions you send us;
• assist you in identifying a project that corresponds with the preferences you communicated to us; and
• where permitted, suggest other real estate projects which correspond with those preferences.

Automated voice calls

Some telephone calls may be placed or assisted by an automated voice assistant.

Where an automated assistant is used, the call will make clear that you are interacting with an automated system. Where a call is recorded, you will also be informed that recording is taking place.

Recordings and written transcripts may be used to process your request, document the conversation, improve service quality and verify the correct handling of leads.

You may ask to end the call at any time.

Matching and preference extraction

In order to suggest relevant projects, Immowi International may analyse the preferences that you provide through contact forms, e-mails, chat conversations, SMS, WhatsApp conversations or telephone calls.

Automated systems may convert this information into structured preferences, for example your preferred location, budget, property type or expected purchase timing.

Immowi International may subsequently calculate a match score between these preferences and available projects.

Further information about this automated processing is provided in section V.

Personal Profile

An interested visitor may receive access to a Personal Profile through MyImmowi.

The Personal Profile may contain, among other things:

• projects about which you requested information;
• projects that may correspond with your preferences;
• information or documents relating to those projects;
• communications between you and Immowi International; and
• preferences you communicated or which were derived from your communications.

Access may be provided through a personal link, one-time login link or another authentication method.

Marketing optimisation

To optimise its services, Immowi International may divide interested visitors into broad categories depending on their expressed property interests, such as residential property, investment property, student accommodation, second homes, international property or luxury property.

These categories may be used to measure campaigns and, where legally permitted, to assist advertising platforms in showing relevant advertising.

Immowi International applies the principles of:

• Transparency. Visitors are informed about the use of their data for advertising and optimisation purposes.
• Data minimisation. Only personal data reasonably required for the relevant purposes are processed.
• Purpose limitation. Personal data are not subsequently used for unrelated purposes without an appropriate legal basis.
• Limitation of impact. No decisions producing legal or similarly significant effects are made solely on the basis of these marketing categories.
• Storage limitation. Personal data are retained only for the periods described in section IX.

Data provided by you

Immowi International may process:

• first name and surname;
• e-mail address;
• telephone number;
• postal code and, where provided, country or region;
• available or intended budget;
• preferred location;
• preferred property characteristics;
• intended purchase period;
• communication preferences;
• preferred language;
• information entered in free-text fields;
• the content of e-mails, chat messages, SMS and WhatsApp messages exchanged with us;
• contact details of representatives of project partners, customers, suppliers and other business partners; and
• other personal data you voluntarily provide during correspondence or interaction with us.

Data generated through use of our services

We may also process:

• IP address;
• information about the page or advertisement that referred you to us;
• advertising identifiers such as gclid, fbclid and comparable identifiers;
• technical and usage data concerning visits to our Websites, Landing Pages and Personal Profile;
• delivery and interaction information relating to communications;
• information concerning whether a telephone call was answered, its duration and its recorded outcome;
• audio recordings of telephone calls where recording takes place;
• written call transcripts;
• summaries and preferences derived from communications;
• match scores between your preferences and real estate projects; and
• information necessary to record and honour an objection or opt-out.

Business contact data obtained from other sources

For business development purposes, Immowi International may obtain professional contact information relating to potential project partners, customers, suppliers or other professional contacts from sources other than the person concerned.

Such sources may include:

• publicly accessible company websites;
• professional networking platforms;
• public company and professional registers;
• publicly available business information; and
• commercial B2B databases and professional data providers.

This processing primarily concerns professional information such as a person's name, professional role, company, business e-mail address, professional telephone number and related company information.

Where Article 14 GDPR applies, Immowi International provides the required privacy information within a reasonable period and, at the latest, when the person is first contacted or when the personal data are first disclosed to another recipient.

The person concerned can object to processing for direct marketing purposes at any time.

Personal data may be collected in the context of:

• visiting our Websites and Landing Pages;
• completing a contact form;
• using the Personal Profile;
• corresponding or communicating with Immowi International or someone acting on its behalf by e-mail, telephone, chat, SMS, WhatsApp or another channel;
• requesting information about a property or real estate project;
• entering into or managing a commercial relationship with Immowi International;
• subscribing to a newsletter;
• attending a seminar, webinar, event or other activity organised by or together with Immowi International; and
• professional prospecting and business development activities.

Providing certain personal data may be necessary to use a particular service. Where appropriate, forms indicate which fields are mandatory and which are optional.

Immowi International may use personal data for the following purposes:

1. Handling requests for information, including contacting you about the project about which you made an enquiry.
2. Passing requests to project partners so that they can contact interested visitors concerning the relevant project.
3. Verifying requests, including checking whether a request is genuine and whether it was followed up.
4. Suggesting relevant or similar real estate projects, where permitted by applicable law.
5. Operating the Personal Profile, including authentication and displaying relevant content.
6. Performing agreements with project partners and other customers, including reporting, invoicing and follow-up.
7. Operating, securing and improving our Websites, Landing Pages and Personal Profile.
8. Optimising our services, including preference extraction and matching.
9. Measuring advertising effectiveness, including determining whether an advertisement resulted in an information request.
10. Sending newsletters and other marketing communications, where legally permitted.
11. Following up professional prospects and business relationships.
12. Conducting customer satisfaction surveys and market research.
13. Compiling statistics and analysing service performance.
14. Honouring objections and opt-outs, including through a do-not-contact register.
15. Preventing fraud, misuse or invalid requests.
16. Complying with legal obligations and establishing, exercising or defending legal claims.

Immowi International relies on one or more of the following legal grounds, depending on the relevant processing activity.

Your request and pre-contractual steps

Where you request information about a particular project, processing necessary to answer that request may take place because it is necessary to take steps at your request prior to entering into an agreement and/or on the basis of our legitimate interest and that of the project partner in responding to a request that you initiated.

Consent

Where required by law, Immowi International requests your consent, for example for certain forms of electronic direct marketing or other processing for which consent is the appropriate legal basis.

Consent is voluntary and may be withdrawn at any time.

Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.

Performance of an agreement

Where you, your company or organisation has entered into an agreement with Immowi International, personal data may be processed to perform and administer that agreement.

Legal obligations

Personal data may be processed where this is necessary to comply with a legal obligation applicable to Immowi International.

Legitimate interests

Immowi International may also process personal data where this is necessary for a legitimate interest pursued by Immowi International or a third party, provided that the interests or fundamental rights and freedoms of the data subject do not override that interest.

These interests include:

(i) Optimising services for project partners

Immowi International has an interest in understanding which types of projects generate interest and in improving the relevance and effectiveness of campaigns.

The impact on individuals is limited by using relatively broad property-interest categories and by not making decisions with legal or similarly significant effects solely on that basis.

(ii) Marketing and advertising optimisation

Subject to applicable direct marketing and electronic communications rules, Immowi International may use limited information concerning existing interested visitors to analyse campaigns, create audiences, measure campaign effectiveness or promote relevant projects.

(iii) Verifying the quality and authenticity of leads

Immowi International has a legitimate interest in establishing whether requests are genuine and whether project partners correctly follow them up.

(iv) Professional B2B prospecting

Immowi International has a legitimate commercial interest in identifying and contacting companies and professional contacts that may reasonably be interested in its services.

Before relying on this basis, Immowi International takes into account the nature of the data, the professional context, the source of the information, the reasonable expectations of the person concerned and their ability to object.

(v) Maintaining a do-not-contact register

Immowi International has a legitimate interest in retaining limited information necessary to ensure that an objection or opt-out is respected.

Withdrawing consent and objecting

You can withdraw consent or object to direct marketing at any time and free of charge.

Depending on the communication channel, you may:

• reply STOP where that functionality is offered;
• click the unsubscribe link included in marketing e-mails;
• state during a telephone call that you no longer wish to be contacted; or
• contact privacy@immowi.com.

Where you object to processing for direct marketing purposes, Immowi International will stop processing your personal data for that purpose.

Limited information may nevertheless be retained on a do-not-contact register to ensure that your objection remains effective.

Immowi International uses automated systems to make its services and project recommendations more relevant.

This may involve:

1. Preference extraction

Automated systems may analyse information contained in:

• contact forms;
• e-mails;
• chat messages;
• SMS and WhatsApp conversations; and
• written transcripts of telephone calls.

These systems may identify information such as:

• budget;
• preferred region;
• preferred property type;
• desired number of bedrooms;
• investment objectives; and
• expected purchase timing.

The resulting structured preferences may be stored with your profile.

2. Match scoring

Immowi International may calculate a match score between your known preferences and the real estate projects available through its platforms.

The score may be used to determine which projects are displayed or suggested first.

Use of artificial intelligence and language models

Immowi International may use artificial intelligence and language-model technology supplied by specialised third-party providers in order to carry out functions such as preference extraction, summarisation, conversation assistance and automated voice interactions.

Where personal data are processed by such providers on behalf of Immowi International, Immowi International requires that they act as processors or subprocessors under appropriate contractual data-protection terms.

Immowi International configures and selects these services so that personal data submitted through its systems are not used by the provider to train or improve general-purpose artificial-intelligence models for unrelated customers, except where a separate lawful basis and explicit arrangement would apply.

The providers used may change over time as Immowi International's technical infrastructure evolves. Information on the main categories of providers and data transfers is included in section VI and section VIII.

No solely automated significant decisions

The automated processing described above does not produce decisions with legal effects or similarly significant effects within the meaning of Article 22 GDPR.

Matching determines which real estate projects may be suggested and in which order. It does not determine whether a person is entitled to purchase a property, obtain financing, receive a particular price or enter into an agreement.

You may contact privacy@immowi.com if you believe information or preferences attributed to you are incorrect or if you wish to contest an automated suggestion.

Immowi International may disclose personal data to third parties where necessary for the purposes described in this Privacy Statement.

Recipients may include:

Project partners

Personal data from contact forms may be transmitted to the relevant real estate developer, agent, broker or other project partner.

The data may be imported into the project partner's own CRM or customer-management environment, including systems such as Salesforce, HubSpot, Zoho, Pipedrive, Teamleader, Microsoft Dynamics 365, Odoo, ActiveCampaign, Whise, Skarabee, OmniCasa, Unlatch, Pipeliner or systems connected through another technical interface.

Advertising and marketing platforms

Providers such as Google and Meta may process limited information to deliver, measure and optimise advertising.

Where Immowi International reports that an advertisement resulted in a request, this may include advertising identifiers and, where supported and legally permitted, identifiers such as e-mail addresses or telephone numbers which have first been transformed through cryptographic hashing.

Communication providers

Immowi International may use providers of telephony, messaging, automated calling and e-mail services, including providers such as:

• Telnyx;
• Vapi;
• Amazon SES; and
• Mailcoach.

Artificial-intelligence and language-model providers

Specialist AI providers may process limited personal data on behalf of Immowi International for automated voice interactions, preference extraction, summarisation, matching or communication assistance.

Where such providers receive personal data on behalf of Immowi International, they are required to process those data under appropriate processor or subprocessor arrangements and in accordance with Immowi International's instructions.

Immowi International does not intentionally configure such services to use visitor or customer data for the training of general-purpose models for unrelated customers.

Software, infrastructure and cloud providers

Immowi International uses software, hosting, database, analytics, security, CRM, integration and cloud infrastructure providers to operate and support its services.

Professional service providers

Immowi International may also disclose limited personal data to professional advisers, IT service providers, developers, accountants, lawyers or other service providers where reasonably required.

Where a third party acts as a processor on behalf of Immowi International, it is contractually required to process personal data only in accordance with documented instructions and applicable data protection legislation.

Immowi International and project partners

The allocation of data-protection responsibilities between Immowi International and a project partner depends on the relevant processing activity.

Where Immowi International and a project partner jointly determine the purposes and essential means of collecting and processing an interested visitor's personal data, they may act as joint controllers within the meaning of Article 26 GDPR.

For such joint activities, responsibilities are allocated between the parties in accordance with the applicable contractual arrangement. In general:

• Immowi International is responsible for the Landing Page, the technical collection of the request, communications it conducts itself and the security of its own systems; and
• the project partner is responsible for the commercial follow-up it conducts and for the security and legality of processing within its own systems.

After personal data have been transferred to a project partner, the project partner may also process those data for its own independently determined purposes. For such independent processing, the project partner acts as a separate controller and is responsible for providing any additional information required by law.

Where Article 26 GDPR applies, a data subject may exercise their GDPR rights against either joint controller in relation to the relevant joint processing.

A request submitted to Immowi International that relates primarily to processing performed by a project partner may be forwarded to that partner for handling.

Legal disclosures

Immowi International may also disclose personal data:

• where required by law, regulation, court order or competent authority;
• where reasonably necessary to establish, exercise or defend legal claims;
• to protect the rights, property or security of Immowi International or others; or
• in connection with a merger, acquisition, restructuring or transfer of all or substantially all of Immowi International's business or assets.

Immowi International does not sell personal data as a business activity.

If you ask Immowi International to stop contacting you for marketing purposes, we may retain the e-mail address or telephone number concerned on an internal do-not-contact register together with limited information necessary to document the objection.

We may also register telephone numbers or other contact information that are identified as invalid or that must not be contacted under an applicable official do-not-call mechanism.

The do-not-contact entry is retained for as long as necessary to ensure that the objection continues to be honoured.

In practice, this may mean that the minimum identifying information remains stored indefinitely.

The information on this register is used solely for suppression, compliance and related evidentiary purposes and is not used to contact you.

Immowi International aims to use hosting and infrastructure within the European Economic Area where this is reasonably available and appropriate.

However, some service providers or their subprocessors may be established in, or may process personal data from, countries outside the European Economic Area, including the United States.

Where personal data are transferred to a country outside the EEA, Immowi International ensures that an appropriate transfer mechanism is used where required.

Depending on the recipient, this may include:

• an adequacy decision adopted by the European Commission;
• certification of the recipient under the EU-U.S. Data Privacy Framework, where applicable;
• the Standard Contractual Clauses adopted by the European Commission in Decision (EU) 2021/914, supplemented where necessary by additional safeguards; or
• another transfer mechanism recognised under Chapter V GDPR.

Where required, Immowi International and its providers also assess whether supplementary technical, organisational or contractual measures are appropriate.

Immowi International does not retain personal data indefinitely merely because storage is technically possible.

Unless a longer period is required by law or is necessary for the establishment, exercise or defence of legal claims, the following standard retention periods apply.

Where the same personal data fall into several categories, the longest applicable justified retention period may apply.

Personal data may also be retained for longer where this is necessary for pending or reasonably anticipated litigation, regulatory proceedings, fraud investigations or other legal claims.

At the end of the applicable retention period, personal data are deleted or anonymised, unless further retention is legally required.

Subject to the conditions provided by applicable law, you have the right to:

• obtain access to your personal data;
• have inaccurate data rectified;
• have incomplete data completed;
• request erasure of your personal data;
• request restriction of processing;
• receive certain personal data in a structured, commonly used and machine-readable format and, where applicable, have them transmitted to another controller;
• object to processing based on legitimate interests;
• object at any time to processing for direct marketing purposes; and
• withdraw consent at any time where processing is based on consent.

Where applicable, you may also raise concerns regarding automated processing as described in section V.

Certain services may no longer be available if personal data necessary to provide those services are deleted or their processing is restricted.

Immowi International may request reasonable information necessary to verify your identity before processing a request.

Exercise of these rights is in principle free of charge.

If you no longer wish to receive marketing e-mails, you may use the unsubscribe link included in the message.

Where supported, you may stop SMS or WhatsApp marketing messages by replying STOP.

Immowi International takes appropriate technical and organisational measures designed to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access.

Depending on the relevant system, these measures may include:

• access controls;
• authentication measures;
• encryption in transit and, where supported, at rest;
• logging and monitoring;
• restricted staff access;
• backup and recovery procedures;
• contractual security requirements for processors; and
• periodic review of access and service-provider arrangements.

Immowi International uses cloud infrastructure and software providers located both within and, where appropriate safeguards apply, outside the European Economic Area.

Any processing or transfer outside the EEA is subject to the safeguards described in section VIII where required.

No method of electronic transmission or storage can be guaranteed to be completely secure. Immowi International therefore cannot guarantee absolute security.

Immowi International may update this Privacy Statement from time to time.

The most recent version will be made available through our Websites and will state the date on which it was last updated.

Where a change is material and applicable law requires additional notification, Immowi International will take reasonable steps to inform the persons concerned.

Our Websites and Landing Pages may contain links to websites or online services operated by third parties.

Immowi International does not control the privacy practices of those third parties.

When you visit another website or service, its own privacy statement and terms apply.

We therefore recommend reviewing the privacy information of third-party websites before providing personal data to them.
